I don't think that charge is liable to stick. There was no hoax in these devices. They were an advertising scheme, nothing more and nothing less, and they did not represent themselves as anything other than they were. It's unfortunate that some guy's life is potentially going to be ruined because of a colossal over-reaction by the police. But if they don't at least stick someone with a felony charge over it, they look even more stupid. Talk about incentive to trump up charges. “Placing a hoax device”?
